LICENSE NOT SALE
This copy of the Stress Resilience Training System (“SRTS Software Product”) and any accompanying documentation is licensed and not sold. The SRTS Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Perceptronics Solutions, Inc. or its subsidiaries, affiliates and suppliers own intellectual property rights in the SRTS Software Product, including copyright, patent and other rights. As Licensee, your right to download, use, copy or change the SRTS Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).
LICENSE USAGE
This Agreement entitles you to install and use one copy of the SRTS Software Product. In addition, you may make one archival copy of the SRTS Software Product as needed to perform normal backup of the device on which SRTS is installed. This Agreement does not permit the installation of multiple copies of the SRTS Software Product, or the installation of the SRTS Software Product on more than one computer or other device at any given time, on a system that allows shared use of applications, on a multi-user network, or on any configuration or system of computers that allows multiple users. Multiple copy use or installation is only allowed if you obtain an appropriate licensing agreement for each user and each copy of the SRTS Software Product. LIMITED WARRANTY
Perceptronics Solutions warrants that the SRTS Software Product will perform substantially in accordance with the accompanying printed and/or online descriptive materials for a period of one year from the date of purchase (the Limited Warranty). Any limited warranties on the SRTS Software Product are limited to one year.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT ADDITIONAL WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
CUSTOMER REMEDIES.
Perceptronics Solutions’ entire liability and your exclusive remedy in respect of this Limited Warranty, shall be, at Perceptronics Solutions’ option, either: (a) return of the price paid; or (b) repair or replacement of the SRTS Software Product that does not meet this Limited Warranty, and that is returned to Perceptronics Solutions with proof of purchase.
This Limited Warranty is void if failure of the SRTS Software Product has resulted from accident, abuse, or misapplication. Any replacement SRTS Software Product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
IN THE U.S. & CANADA: NO OTHER WARRANTIES.
To the maximum extent permitted by applicable law, Perceptronics Solutions disclaims all other warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, with respect to the SRTS Software Product and the accompanying materials. This Limited Warranty gives you specific legal rights and you may also have other rights which may vary from state to state, province to province or country to country.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by applicable law, in no event shall Perceptronics Solutions or their respective suppliers be liable for any consequential damages whatsoever, including, without limitation, damages for loss of business profits, business interruption, loss of business information or other pecuniary loss arising out of the use or inability to use the SRTS Software Product, computer failure or malfunction, or any and all other commercial damages or losses, even if Perceptronics Solutions or any of such suppliers has been advised of the possibility of such damages. In such case, Perceptronics Solutions’ and their respective suppliers’ entire liability shall be limited to the amount paid by you for the SRTS Software Product. Because some states/provinces/countries do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
ACCEPTANCE
YOU HAVE ACCEPTED AND AGREED TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY DOWNLOADING AND INSTALLING THE SRTS SOFTWARE PRODUCT.
